While the circumstance may seem black and white from your standpoint, there are lots of gray areas in assault cases. If someone suffers a serious bodily injury, the charges can be enhanced. If a deadly weapon was used, you will be charged with first degree assault no matter what. But what is considered a serious injury? And what is considered a deadly weapon?
For example, in a bar fight, someone who hits another with a chair can be charged with first degree assault, while another patron who hit someone in the head with a fist might only be charged with second degree assault. I will hold the prosecution to its burden of proof, and clearly explain the circumstances to the judge and jury.
There are a number of ways to defend against assault charges. Many people who are charged with assault were acting in self-defense. In other cases, the victims exaggerated their injuries. In some cases, there are lots of participants in a fight and there is now way to know who did what.
